Terms of Service

These Terms of Service (“Terms”) govern your use of the RunRookie mobile app (“App”) and the website at runrookie.app (“Site”), provided by Zektek (“Zektek,” “we,” “us,” or “our”), together the “Service.” By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian.

Health and safety disclaimer

RunRookie provides general fitness guidance, including running programs, voice coaching, and tracking tools. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

  • Talk to your doctor before starting this or any exercise program, especially if you have a medical condition, are pregnant, or have not exercised recently.
  • Stop exercising and seek medical attention if you feel pain, dizziness, shortness of breath, or any other warning signs.
  • Run in safe locations, follow traffic and pedestrian laws, and stay aware of your surroundings — especially when using audio cues or headphones.
  • GPS-based distance, pace, and calorie estimates are approximations and may not be perfectly accurate due to device and signal limitations.

You use the Service, and engage in any exercise program or activity in connection with it, at your own risk.

The Service

RunRookie includes a free Couch to 5K program and a Bridge to 10K graduate program, along with run tracking, voice coaching, statistics, achievements, and related features. A limited number of workouts are available for free; access to the remainder of the program requires an auto-renewing subscription as described below.

We may add, change, or remove features of the Service at any time, including the number of free workouts available.

Subscriptions

Subscriptions are sold and billed through the Apple App Store or Google Play, using the payment method associated with your store account. By purchasing a subscription, you agree to that store’s terms of payment in addition to these Terms.

  • Subscriptions automatically renew for the same term unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription, and view pricing and renewal terms, in your App Store or Google Play account settings.
  • Refunds are handled by Apple or Google in accordance with their respective policies — Zektek cannot directly process refunds for store purchases.
  • If you cancel, you will keep access to subscription features until the end of the current billing period.

Acceptable use

You agree not to:

  • Use the Service in any way that violates applicable laws or regulations.
  • Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law.
  • Interfere with, disrupt, or attempt to circumvent the Service’s subscription or security mechanisms.
  • Use the Service to share content that is unlawful, harmful, or infringes the rights of others (for example, via the App’s share-card feature).

Intellectual property

The Service, including its software, design, text, graphics, logos, and branding, is owned by Zektek or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to use Zektek’s branding without our prior written permission.

Your run data, photos, and any content you create using the Service remain yours. By using the share features, you choose when and how to share that content through your device’s share options.

Third-party services

The Service relies on third-party platforms and services, including the Apple App Store, Google Play, Apple Health, Health Connect, RevenueCat, and PostHog. Your use of those services is subject to their own terms and policies, and we are not responsible for their availability or performance.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GPS, HEALTH, OR OTHER DATA WILL BE ACCURATE OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEKTEK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY EXERCISE ACTIVITY UNDERTAKEN IN CONNECTION WITH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, ZEKTEK’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.

Termination

You may stop using the Service and uninstall the App at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with notice where required by law.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide notice within the App. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles, except where applicable consumer protection laws in your jurisdiction provide otherwise.
